Hi Mujun, thanks for bringing this up in class this past week. I was unware of this case. I started reading more articles pertaining to this case and others. I don’t really know anything about the laws, rules and or regulations in China but they seem very patriarchal. It seems absolutely ridiculous that the court can just throw out a case if they don’t have video, recordings, or photographs of the assault in action. They are basically telling people well unless you can show us actual proof then it didn’t really happen. I see that only a few sexual harassment/assault cases have actually made it to court, which makes China “look” like they don’t have a sexual harassment/assault problem.
This reminds me of my time in South Africa, most crimes of sexual harassment/assault go unreported for many reasons. First, most of the police are men. As a young women, who has just been sexually assaulted by a man, how hard would it then be to tell a man what just happened to you. Second, lots of girls/women feel that if they come forward they won’t be believed that anything “actually happened”. Third, by coming forward they may just cause more trouble or harm for them self because the assailant may retaliate.
I will stay updated on her case, I hope she can win the appeal.
Dear Yanci, you raised a good point that we don’t have many women in police force. Actually, there are many cases in China that women police officers treat those sexual harassment more seriously than men officers. Some men officers will blame the victim for making up or dressing inappropriately. Actually there is a myth: how can women collect evidence of sex assaults/sex harassments when they just experienced it unexpectedly.
